2. Account and Security

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

• Maintaining the confidentiality of your account and password
• Restricting access to your computer and/or account
• Accepting responsibility for all activities that occur under your account
• Notifying us immediately upon becoming aware of any breach of security or unauthorized use of your account

3. Payments and Refunds

Kitchain offers subscription packages for access to the Platform. By selecting a subscription package, you agree to pay the subscription fees indicated for that service. Fees are non-refundable except as required by law or explicitly stated in these Terms.

All payments are processed securely through our payment partners. You are responsible for ensuring that your payment information is accurate and up to date.

4. User Content

You retain ownership of any content you submit, post, or display on or through the Platform. By submitting content, you grant Kitchain a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with operating the Platform.

You are solely responsible for the content you submit and must ensure it does not violate any applicable laws or infringe on the rights of third parties.

5. Limitation of Liability

To the fullest extent permitted by law, Kitchain and its directors, employees, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall Kitchain's total liability to you for all claims exceed the amount you have paid to Kitchain for use of the Platform in the 12 months preceding the event giving rise to the liability.

6. Termination

Kitchain reserves the right to terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Upon termination:

• Your right to use the Platform will immediately cease
• All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability
• Kitchain may, but is not obligated to, delete or archive your data after termination

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
